Department of Labor Cracks Down on Tips at Small Town Restaurant


An Ohio based worker owned restaurant, Casa Nueva, has issued a new policy of no tips because of auditing by the Department of Labor.

Due to a recent policy change within the Department of Labor, Casa Nueva is no longer able to pool all tips among employees.

Based on a previous agreement, employees of Casa Nueva (from the dishwasher to the cook) would be able to partake in any tips that were collected in a given pay period. Based on the policy change Field Assistance Bulletin No. 2012-2, only employees who are customarily allowed to collect tips such as waiters would be allowed to partake in tip pools.
