Cardi B Continues To Conquer In Federal Court, Copyright Case Dismissed

The judge noted a significant procedural failure regarding copyright registration.


Cardi B secured another win in court. A federal judge has officially dismissed a $50 million copyright infringement lawsuit filed against the rapper.

The lawsuit targets Cardi’s 2024 hit single, Enough (Miami). Originally filed by a group named Kemikal 956, which consists of Joshua Fraustro and Miguel Aguilar, the lawsuit alleged that “Enough (Miami)” utilized an unauthorized sample from an obscure 2021 instrumental track, “Greasy Frybread.”

The plaintiffs claimed that the song’s distinctive bass line and percussion patterns were “strikingly similar” to their protected work. However, the court found that the musical elements in question were “commonplace. Furthermore, the claim did not meet the threshold for copyright protection. Ultimately, U.S. District Judge Fernando Rodriguez Jr. ruled in favor of Cardi B and her legal team at Atlantic Records, Complex reported.

The court’s decision centered primarily on a lack of personal jurisdiction over the defendants. Cardi B resides in New Jersey; her labels are based in New York and Delaware.

Rodriguez rejected the argument that her national tour stops in Texas constituted “targeting” the state for legal purposes. Furthermore, the judge noted a significant procedural failure regarding copyright registration. At the time of the 2024 filing, the Aguilar and Fraustro had not secured a federal registration for “Greasy Frybread,” which invalidated their original claim. 

Rodriguez described the pleadings as missing the essential elements necessary to state a valid legal claim under federal law. The plaintiffs also attempted to reframe their grievances under Texas state law to bypass federal registration requirements. The court ruled these efforts were preempted by the Federal Copyright Act and were therefore invalid.

Along with this victory, Cardi B continues her fight to collect her coins from blogger Tasha K. In 2022, the rapper was awarded a nearly $4 million judgment against the content creator for defamation. 

Despite Tasha K’s multiple attempts to seek bankruptcy protection and move her operations abroad, Cardi B’s legal team has continued to aggressively pursue the vlogger’s assets. The rapper is demanding information about wire transfers and offshore earnings.
