Fearless Fund CEO Arian Simone Pushes President Biden To Ignite Executive Action On DEI Following Appeals Court Decision

Founding Partner and CEO of the Fearless Fund Arian Simone is calling for President Biden to step in on the fight against diversity, equity, and inclusion (DEI) after an appeals court ruled it could no longer issue funding for Black women businesses only

During an interview with CNN’s Abby Phillip, Simone spoke out following the June 3 ruling. Judges in the 11th Circuit of the U.S. Court of Appeals voted 2-1 to uphold the injunction from Edward Blum’s lawsuit against the venture capital fund and foundation. 

Talking to Phillip from Cape Coast Castle in Ghana, which was used as a holding place for slaves before they were shipped to the Americas, Simone said she is very “disturbed” by the ruling. She continued by putting pressure on the president to take immediate executive action in order to protect diversity, equity, and inclusion as there are heavy right-wing efforts to eliminate it. “Right now, I would like to send a signal and a request to the United States of America to issue an executive order to stand up for DEI,” Simone told Phillip after being asked what else could be done. 

“We deserve the right to protect the ability to fund marginalized communities and demographics that can be clearly shown there are racial disparities. We deserve that. We need an executive order. We need a signal to the DOJ.”

The high court’s decision supported the conservative activist’s claim that the grant program could be labeled as discriminatory and overturned a previous decision by a federal judge that found the lawsuit unlikely to succeed on the grounds of the First Amendment. The decision marked a blowback for the Atlanta-based Fearless Fund, which was established to increase venture capital funding for Black women and could impact other race-based initiatives in the private sector.

After the ruling announced the fund was in violation of Section 1981 of the Civil Rights Act of 1966 — a law she says was “clearly put in place post slavery for Black people to have an opportunity for economic freedom by giving them the legal right to enter into contract” — Simone agrees with supporters who feel the laws are being used to weaponize against Black people. “They have flipped this law on its head,” she said. 

“It was clearly put in place to protect and provide, and now it’s being used, through court systems, as a way to dismantle diversity.” 

As DEI initiatives are being eliminated in various spaces across the country, including educational institutions and Fortune 500 companies, concern from the VC founder has heightened as she feels the ruling will stamp a new precedent for other venture capital firms across the board. “People are looking to see this as a benchmark as far as what the future of VC will look like. Right now, Black females are the fastest-growing entrepreneurial demographic. And Black and Brown women — women of color — are the most founded but the least funded,” Simone said. 

“And this is very concerning where only a fraction of a percent of those funds in venture capital go to women of color. And if you were to ever stop an organization like the Fearless Fund, this means that you now have precedent to stop others and we cannot allow that.”

Will Smith dominated the box office this past weekend with the latest installment to his Martin Lawrence-assisted buddy cop film franchise, Bad Boys: Ride or Die. But there’s one public figure who isn’t supporting a Will Smith movie until he takes time to “talk to the Black community” about slapping Chris Rock at the 2022 Academy Awards.

Sports commentator Stephen A. Smith took to his nightly podcast on Sunday, June 9, to explain why he is boycotting the latest Bad Boys film, despite the warm reception it received at the box office. In a segment titled “Are we embracing Will Smith again?” Stephen A. brought attention to Will Smith avoiding the Oscars slap topic during his Bad Boys press run and why it’s rubbing him the wrong way.

“Will Smith apologized. I’m not saying he even has to apologize. I’m saying that while I watch him and Martin Lawrence promoting this movie, and I’m quite sure the reason he hasn’t addressed it is because the studios don’t want him to, and there’s an obligation that you have with them, all fear,” Stephen A. explained.

“I get it. But somewhere along the way, he has to sit down and talk to the Black community. You can see all the White people around Will Smith, all you want to. Black folks have loved and revered this man for decades.”

While expressing his genuine “love” for Will Smith, Stephen A. explained why the superstar actor still owes an explanation to Black people due to the setback he placed on the community as a whole when he stepped on the Oscars stage and slapped another Black man for the world to see.

“Everybody makes a mistake. This is not hatred. I love Will Smith still, but you got to have a conversation as to why you did that,” Stephen A. said

“And when you’re apologizing, and when you get emotional, and when you’re thinking about all the lives or the people that you’ve affected, it’s primarily us as Black people who have loved and supported you and watched you go on an international stage and slap one of us in the face, and tarnished a historic event for one of the great Black producers of modern times in Will Packer. Possibly costing yourself and Antoine Fuqua an Oscar for ‘Emancipation'”‘ along the way.”

Stephen A. also shared his belief that Will Smith wouldn’t have physically assaulted any white comedians like “Ricky Gervais, Bill Maher, Bill Burr, and a host of others” the way he did Chris Rock. As a result, Stephen A. is among the group of people who still can’t muster up the energy to go out and support a Will Smith film.

“A lot of folks ain’t get over that. A lot of folks find it hard to just go to the movies to watch you. I’m one of those people,” Stephen A. said.

When a clip of Stephen A.’s rant made its way on social media, the ESPN host doubled down on his claims and teased the update he would be providing to his Will Smith debate.

“Yep. I said it. But I have some additional thoughts — thinking about all that Will & Martin have done for us all — especially after talking to my man Charlie Mack,” Stephen A. tweeted. “I’ve got more to say on ‘The Stephen A. Smith Show/Podcast’ tomorrow.”

However, the First Take host continued to come under fire from many who believe he’s being too hard on Will Smith.

“Why do we need you to further elaborate on a terrible take?” one critic wrote.

“He already did Red Table Talk, he apologized to Chris and reached out to him. The Academy already suspended him for 10 years. It’s time to move past this,” added someone else.

The fourth installment to Will Smith and Lawrence’s 30-year-old action franchise swept the box office during opening weekend, raking in $105 million globally with $56 million domestically. It was a huge comeback for the King Richard star who experienced a fall from grace following his infamous Oscars slap against Chris Rock over two years ago.

The success of Bad Boys: Ride or Die showed the box office success Smith could still receive even in the wake of a physical assault captured on national television. But Stephen A. is showing that a few emotional apologies aren’t enough for a box office superstar and he demands more from Will Smith.

Former President Donald Trump knew the best way to rally supporters for the upcoming presidential election – by telling voters, “I don’t care about you. I just want your vote.” 

Trump stood in front of a crowd of potential voters on June 9 in the sweltering and dangerous Las Vegas heat while complaining about the teleprompters that he claimed didn’t work. After going the extra mile to make sure participants had water and allowed people to carry in umbrellas, he prompted the crowd to celebrate the “breeze” created by fans. “Do you feel the breeze? I don’t want anybody going on me. We need every voter,” he said. 

“I don’t care about you. I just want your vote. I don’t care.”

Temperatures in Sin City exceeded 100 degrees Fahrenheit as Clark County Fire Department said a majority of medical calls received were heat-related. Six people were sent to the hospital, and close to 30 people were treated on site at the rally. After saying he was joking with his sentiments, he announced his campaign workers would offer assistance to anyone feeling “tired,” including how “everybody,” such as the U.S. Secret Service, was more worried about the safety of the crowds over him. 

“They never mentioned me. I’m up here sweating like a dog,” he said. “This is hard work.”

However, a number of critics didn’t think his jokes were funny. Several jumped to social media to criticize his comments. “He’s finally telling the truth,” Rep. Malcolm Kenyatta (D-Pa.) wrote. 

Another Twitter user was shocked that people didn’t take his comments as a signal to leave. “Did his fans hear that and NOT walk out? How is it possible for one man to have an abusive, toxic relationship with millions?,” @marc92gold said. 

The rally in Nevada was his second rally appearance since he was found guilty of 34 counts in a hush-money scandal. While Trump claimed the weather was “not as bad” as he thought it would be, the dry heat is not anything to play with. According to Newsweek, 11 people were hospitalized with heat exhaustion after waiting in line for an indoor Trump rally in Phoenix on June 6. As temperatures reached 110 degrees, several people fainted from the heat.

But some, like Camille Lombardi, still didn’t care as the Vegas rally was the first time she was seeing the former president in person. “You know what? It’s worth it,” the retired nurse from Henderson, Nevada, said.

“Too bad it wasn’t indoors, but that’s OK.”

On June 8, Bernice King, the youngest daughter of the iconic Martin Luther King Jr., addressed hundreds of women at the Black Girls Dream Conference.

Bernice candidly opened up about her upbringing as a shy and inquisitive young girl surrounded by tragedy yet exposed to resilient women who shaped her journey. “I went through some seasons of having a lot of anger because of all the loss I had in my life,” she revealed during the live session posted on the Southern Black Girls and Women’s Consortium’s YouTube channel. The lawyer further opened up about her realization that her temper was self-destructive.

Raised in a family of extraordinary leaders, Bernice was instilled with faith, strength, and an understanding of her power. She spoke highly of her mother, Coretta Scott King, crediting her father’s notability to Coretta’s support. “She was a powerful woman in her own right before she met him,” Bernice said and emphasized the pivotal role played by the village of Black women around her in navigating the world.

The peace advocate challenged attendees to master and discipline their emotions, sharing an invaluable lesson from her mother –- to never make a decision while she was angry. She underscored the importance of including God as a partner in life’s decisions, stating, “When you’re making decisions in life, don’t leave out God…You need Him as a partner.” Moreover, she emphasized finding one’s purpose, urging attendees to find a problem they can answer and provide a solution for. Bernice challenged the women in the room to identify the problem they were called to solve and stand firm in their purpose as women.

Reflecting on her upbringing, Bernice sees herself as a role model for dignity in a world with few examples. “I’m obviously a student of my father’s nonviolence,” she stated, clarifying that nonviolence is a “spiritual thing and a mindset, transcending the physical realm.

The conference, hosted for the fourth year by the Southern Black Girls and Women’s Consortium, gathered over 1,300 girls and women in Atlanta for a weekend of inspiration and empowerment focused on Afrofuturism. According to the conference website, the 2024 event aimed to inspire attendees to dream bigger through workshops, discussions, and resources for executing those dreams.

Travis Scott Settles Final Lawsuit Associated With Astroworld Festival Tragedy

The family of 9-year-old Ezra Blount, the youngest victim to die in the stampede, has settled with Scott, Live Nation Entertainment, Apple, and other companies.


Numerous lawsuits were filed against recording artist Travis Scott and companies associated with the 2021 Astroworld Festival tragedy. All have been settled, and the last one was agreed upon mere months before it was scheduled to go to trial in September.

According to The Houston Chronicle, the family of Ezra Blount, who at 9 was the youngest victim to die in the stampede that occurred at the festival while Scott was on stage performing, has settled with Scott, Live Nation Entertainment, Apple, and other companies involved with the festival. An attorney for the family confirmed the settlement with the media outlet.

“The family is happy to resolve its claim against all defendants following the death of their son, Ezra,” S. Scott West said. “They look forward to continuing the process of healing and never forgetting.”

Last August, it was reported that the families of Axel Acosta and Brianna Rodriguez settled their lawsuits, and according to Rolling Stone, the family of John Hilgert, who was 14 years old at the time of death, settled its lawsuit against Live Nation, Travis Scott, and other Astroworld organizers six months before the aforementioned families.

On Nov. 5, 2021, 10 people, ranging in age from 9 to 27 years old, died at the Astroworld festival. Approximately 300 attendees were injured and treated at the venue; 25 were taken to local hospitals.

In July 2023, the Houston Police Department released a nearly 1,300-page report on the tragedy after an extensive investigation. According to Rolling Stone, “The report detailed a chaotic scene in which fans, security personnel, and camera operators tried to relay the danger early in the show as the crowd constricted and festivalgoers were crushed—but the concert went on for an hour before finally concluding.”  

Scott was recently in the news following an altercation with Cher’s boyfriend, Alexander “AE” Edwards, during a party at the Cannes Film Festival. People reported that Scott, 33, Edwards, 38, and Cher, 78, had attended New York City nightclub owner Richie Akiva’s “The After” party on May 23 at a private villa following the AmfAR Gala.

West Virginia Makes Juneteenth A State Holiday

West Virginia Gov. Jim Justice released a state proclamation declaring Juneteenth a state holiday.


On June 7, West Virginia Gov. Jim Justice released a state proclamation declaring Juneteenth a state holiday. The proclamation officially makes June 19 a paid holiday for all public employees in West Virginia. 

According to WBOY, Juneteenth was declared a federal holiday in 2021 when President Joe Biden signed the Juneteenth National Independence Day Act. Juneteenth commemorates the day enslaved people in Galveston, Texas, were informed that they were free as a result of the Emancipation Proclamation. As a result, the holiday is also referred to as Emancipation Day. 

According to Gov. Justice’s proclamation, “Now, therefore, I, Jim Justice, pursuant to the foregoing and by virtue of the authority vested in me as the Governor of the State of West Virginia, do hereby proclaim and order that Wednesday, June 19, 2024, shall be treated as if it were an official holiday, and the public employees of this State may be excused from their work duties on that day without charge against accrued annual leave.”

The creation of the federal holiday signaled an explosion in the celebration of the holiday, which gained renewed interest from politicians after the murders of George Floyd and Breonna Taylor by police officers in the summer of 2020, The New York Times reported. 

Mark Anthony Neal, an African-American studies professor at Duke University, told the Times that he felt like Juneteenth represented a chance for folks to catch their collective breaths following sweeping changes in the wake of the reckonings spurred by Floyd and Taylor’s deaths. 

“The stakes are a little different. I think Juneteenth feels a little different now, Neal said. “It’s an opportunity for folks to kind of catch their breath about what has been this incredible pace of change and shifting that we’ve seen.”

Opal Lee, affectionately referred to as the “Grandmother of Juneteenth,” was a key figure in generating momentum for the holiday to become a national holiday. “People just think of Juneteenth as a festival and as a Texas thing. Unity, freedom, is what Juneteenth is all about,” Lee told Oprah Daily in 2021. She described her inspiration for a march from Fort Worth to Washington, D.C. So I decided that I would walk from Fort Worth to Washington, D.C., doing two and a half miles in the morning and two and a half in the afternoon to symbolize that in Texas, the enslaved didn’t know they were free for two and a half years after everybody else.”

High School Athletes In 30 States To Gain NIL Opportunities

Students have a number of protections as well as prohibitions on what they can endorse, for example, an athlete cannot be endorsed by alcohol, gambling or vaping companies or be endorsed by a collective, such as those present at the collegiate level.


High School athletes are now going to be allowed to cash in on the earning potential of NIL deals. In 30 states, student-athletes will be allowed to participate in the name, image, and likeness marketplace. Unlike the process in college, these athletes are not of legal age to negotiate deals, so their parents have to be involved.

As NBC News reported, in Florida although some deals are already signed, such as the deal Adidas has in place with Jones High School student Vernell Brown III in Orlando, the deals cannot become active until the Florida State Board of Education votes to ratify the new rules in July. In addition to Brown, Adidas has agreements with six other high school athletes.

Brown, one of the most sought-after high school football players in the country, told NBC News, “Just like collegiate athletes and professional athletes who put that time in working hard, I think high school athletes put that in as well.”

Brown added, “They’re grinding to get to that next level, so I definitely think there should be some benefit … that pays off for their hard work and ultimately gives us a financial jump-start in life. I’m extremely grateful for it. I think it definitely means more of being on the forefront [of NIL in Florida].” 

Students have a number of protections, as well as prohibitions, about what they can endorse. An athlete, for example, cannot be endorsed by alcohol, gambling, or vaping companies or be endorsed by a collective, such as those present at the collegiate level.

Brown’s father, Vernell Brown Jr., a former college athlete and current mentor of Indianapolis Colts player Anthony Richardson, noted the development is critical for Black athletes. 

“I think it’s extremely critical,” he said. “When you look at families and specifically the population of the NFL, it’s predominantly African American athletes. So I think having this opportunity to kind of set yourself up and then your family … there’s obviously the financial piece with NIL, but I think just the platform is [also] bringing more notice. I think it’s important to have representation and somebody to help you with an agreement and make sure you understand what you’re signing. The parents definitely need to be involved.”

According to an Adidas spokesperson, the deals are structured for one year, or until the player has left to attend college, but will not conflict with any deals the player signs after entering college.

Apple, Propel Center To Host Accelerator Program for HBCU Students

Participants will use Apple technology to create music, album art, and digital marketing stories, engage in career conversations, and network with industry expert.


Apple and the Propel Center will host 50 students from 19 HBCUs as part of an arts and entertainment industry accelerator program.

The Propel Center was launched by Apple and Southern Company three years ago in order to advance the work being done by HBCUs and their students. According to Variety, the program will begin June 10 at Tennessee State University and will end at Atlanta’s Clark Atlanta University during the week of June 16.

Participants will use Apple products and technology to create music and album art and use tenets of digital marketing to tell stories as well as participate in conversations about careers, socialize with industry experts, and utilize resume-building workshops. 

“Creativity is central to everything we do at Apple, and we’re thrilled to help create more pathways into the arts and entertainment industries for HBCU students,” said Alisha Johnson Wilder, director of Apple’s Racial Equity and Justice Initiative. “Through Propel Center’s programming we’re helping expand opportunities for emerging creators from diverse backgrounds by ensuring these talented students have access to the technology, resources, and expertise they need to become leaders in the creative arts.”

Propel Center President Lisa Herring added, “Harnessing the undeniable power of creativity and collaboration has enabled Propel Center and Apple to establish a nurturing and inspiring environment to cultivate the many talents of our HBCU students. This year’s accelerator marks a continued commitment from Apple and our industry partners to help address equity and diversity gaps in the arts and entertainment industry and other critical business sectors.”

Apple has not walked back its commitments to social justice and that commitment is best evidenced through its Racial Equity and Justice Initiative (REIJ). Apple’s support for both the Propel Center and the 2024 Arts & Entertainment Industry Accelerator is a part of this wide-ranging set of programs and policies established to support Black, Latinx, and Indigenous communities.

“We established the program with a $100 million commitment, and since then, we’ve more than doubled our commitment to over $200 million,” according to Apple’s REIJ 2023 Impact Overview. “This funding supports projects and partnerships across three priority areas: education, economic empowerment, and criminal justice reform. These are areas where we’ve historically seen disproportionate impacts for underresourced communities.”
