Belgian Court Rules Colonial-Era Family Separations Were Crimes Against Humanity, Awards Reparations To Victims

The government will have to pay reparations to the families of five mixed-race women who were forcibly separated from their families in the colonial-era Belgian Congo.

In his 1899 semi-autobiographical novella Heart of Darkness, author Joseph Conrad explored the horrors of colonialism, which centered on the exploitation and oppression of African people in what is now the Democratic Republic of the Congo by Belgium. On Dec. 2, a court in Belgium ruled that the country would now have to pay for its crimes against the Congolese people.

The Belgian Congo was a Belgian colony in Central Africa from 1908 until independence in 1960, when it became the Republic of the Congo.

According to the BBC, the government will have to pay reparations to the families of five mixed-race women forcibly separated from their families in the colonial-era Belgian Congo.

The women, who are now all in their 70s, are owed the compensation because they were taken from their mothers as young children and placed in various orphanages, which the court said was evidence of Belgium’s “plan to systematically search for and abduct children born to a Black mother and a white father.”

The panel of judges referred to the actions perpetuated by the Belgian government as a crime against humanity, calling the kidnappings of the women “an inhumane act of persecution.”

The ruling follows a legal case from Monique Bitu Bingi, Léa Tavares Mujinga, Noëlle Verbeken, Simone Ngalula, and Marie-José Loshi, launched in 2021.

Bingi previously characterized their abductions as a destruction in comments to the AFP News Agency.

“We were destroyed. Apologies are easy, but when you do something you have to take responsibility for it,” Bingi said.

Because the court ruled the actions of the Belgian government and the orphanages mostly managed by the Catholic Church a crime against humanity, there is no statute of limitations on their allegations against the Belgian government.

“The court orders the Belgian State to compensate the appellants for the moral damage resulting from the loss of their connection to their mother and the damage to their identity and their connection to their original environment,” the judges proclaimed.

In 2019, the Belgian government apologized publicly, two years after the Catholic Church did the same for its involvement in the forced removal of children from the custody of their mothers.

The case is the first to address the plight of an estimated 20,000 victims of family separation in the Democratic Republic of the Congo, Burundi, and Rwanda.

According to Michèle Hirsch, one of the plaintiff’s lawyers, “This is a victory and a historic judgment. It is the first time in Belgium and probably in Europe that a court has condemned the Belgian colonial state for crimes against humanity.”

Bingi, who was removed from the custody of her mother at three years old, told The Guardian that the women jumped for joy when they received the news.

“I am relieved,” she said. “The judges have recognized that this was a crime against humanity. We jumped for joy.”

According to their reporting, the Belgian government maintained order through white supremacy, and mixed-race children born through the union of white fathers and Congolese mothers represented a threat to this arrangement.

This arrangement was the brainchild of King Leopold II, who ruled the Congo from 1885 to 1908 when he ceded it to the Belgian state, which endeavored to fulfill his wishes.

The judges granted the women’s request for €50,000 ($52,852) in damages because if they lost, they would be liable for that amount.

In part, they arrived at their ruling because Belgium was a signatory of the Nuremberg tribunal statute, which was set up to convict members of the Nazi Party of their crimes during the Holocaust.

In addition to this judgment, the court also ruled that the government would be required to pay “more than €1m” ($1,057,050) in legal costs.

According to The Guardian, the girls were officially designated as “mulattoes,” an offensive term denoting a mixed person’s parentage, and had their documents falsified.

While at the Catholic missions, the girls were often told they were “children of sin” and received little care or rations from the nuns, who despised looking after the children.

Further, two of the girls were raped by members of a militia set up as the Congo gained its independence in 1960.

According to The Guardian, following a 2018 apology issued by then-Belgian prime minister Charles Michel, the government set up an official government body, the Résolution-Métis, to help people who had been taken from their parents to trace their origins, but has since declared that sources in that effort are “deficient and fragmentary.”

Tyler Perry Honored At Paley Center Gala: Oprah, Meghan Markle, And Kerry Washington Celebrate His Legacy

The stars came out to celebrate Tyler Perry being saluted at The Paley Honors Tribute Gala.

Oprah Winfrey, Meghan Markle, and Kerry Washington were among the many A-listers who attended the Paley Honors Tribute Gala on Wednesday to celebrate Tyler Perry’s recognition.

Variety reports that the multifaceted entertainer and media mogul was honored at The Paley Center for Media’s annual fall gala for his remarkable achievements over the past two decades as an actor, writer, director, producer, philanthropist, and owner of the 330-acre Tyler Perry Studios in Atlanta. Winfrey gave an impassioned salute to Perry to kick off the night and celebrate her “big little brother.”

“I am just delighted to be here tonight — and I really do mean that, because I don’t like to go out much — but I’m out tonight because I get to talk about my big little brother,” she began.

“He is a giant among men. Not only in what you see in his 6’6″ physical stature, but he is a giant soul. He has a ginormous spirit that is guided by a divine hand.“

Winfrey praised Perry’s ability to “create art that lets people know they matter.” Her words were supported by an elite group of guests, including Hollywood producer Nicole Avant, Netflix CEO Ted Sarandos, veteran entertainment executive Debra L. Lee, Debbie Allen, LaTanya Richardson Jackson, Cookie Johnson, Tina Knowles, Ebony Obsidian, Tika Sumpter, Diane Warren, and Yvette Nicole Brown.

Perry sat alongside friends Duchess Meghan Markle and actress Kerry Washington (who hosted the evening) and got emotional listening to Winfrey sing his praises.

“The majority of people watch the news and they think, ‘Oh, what a shame,’” Winfrey said. “Tyler watches and says, ‘What can I do now to make a change?’”

Washington credited Perry with helping to reignite her career when it reached a stagnant point, and she considered retiring from acting after achieving a personal goal of starring on Broadway. However, Perry had other plans when he offered her a role in For Colored Girls and motivated her to continue acting onscreen.

“Tyler encouraged me to dream a bigger dream for myself, to reach further, to dream that there was something out there for me that was beyond what I had imagined,” she shared. “He invited me into a world with my peers and with my heroes, and he told me that I belonged, and it changed the trajectory of my career.”

Perry received his award from Avant and Sarandos before taking the stage to deliver a heartfelt 10-minute speech. He shared how challenging this time of year is for him, as it marks the anniversary of his mother, Maxine Perry’s, passing. Perry also opened up about the traumas of his childhood, recounting his experiences of witnessing his father abuse his mother, enduring sexual abuse, being racially profiled by police, and witnessing a teacher kill his pet hamster under the pretense of a science experiment.

“The very fact that I can stand here today — and that little boy who didn’t have the tools that I have as a man was able to make it — I think that’s enough to allow myself to celebrate,” Perry said.

“At 55 years old, I am the freest version of myself that I’ve ever been. I turned toward all of that pain, threw my arms wide open, embraced every bit of it, stared at the shame, went down in it, and took the power out so that I could heal. And I would challenge each and every one of you to do that as well.”

Rep. Maxwell Frost Slams Trump’s DOGE: ‘It’s A Joke’

Democrat Frost said the Department of Governmental Efficiency, headed by Elon Musk and Vivek Ramaswamy, is billionaires ‘cosplaying as government officials.’

Florida Rep. Maxwell Frost had strong words regarding President-elect Donald Trump’s proposed Department of Governmental Efficiency (DOGE) to be run by Elon Musk and Vivek Ramaswamy, calling the pair “two billionaires who are cosplaying as government officials” in a Dec. 5 appearance on MSNBC.

According to The Hill, in Frost’s comments on Joy Reid’s MSNBC show, The Reid Out, he underscored that DOGE is not an official department, despite its name.

“Let’s be honest about DOGE and this whole thing; it’s a joke,” Frost also noted that DOGE is “not an actual department of this government.”

Frost continued, “I’m all for making our government more efficient, but we have to look at the proposition here. The proposition of these two guys is that to make the government more efficient we gotta fire a bunch of people and take away a bunch of funding. And that lack of nuance and actually providing real oversight on how we can make the government work in a better way shows me firsthand that they are not coming at this on the right foot and not coming at it from the right place.”

Many have publicly questioned Musk’s ability to run DOGE and whether he should be privy to confidential governmental information. In fact, in September, following a post that Musk made on X that seemed to advocate for an assassination attempt on either Vice President Kamala Harris or President Joe Biden, Wired posed that Musk posed a significant national security risk.

Later, Musk asserted on Twitter/X, which he owns, “Starlink was barred from turning on satellite beams in Crimea at the time because doing so would violate US sanctions against Russia!”

According to Richard Blumenthal, the chairman of the Senate Judiciary Subcommittee on Privacy, Technology, and the Law, Musk, who has hefty defense contracts through his various business entities, represents a profound threat to national security. Musk is the CEO and founder of SpaceX, the CEO of Tesla, the owner of X, and the co-founder of OpenAI.

“I think it is beyond dangerous. I think it is a profound threat to our national security that Mr. Musk and SpaceX are in this position,” Blumenthal said in a November hearing regarding US technology companies and their ties to China.

Blumenthal continued, “Those extensive economic ties and China’s willingness to exploit them are a dangerous combination, a real risk to this country,” Blumenthal also said that Musk and Tesla “are far from the only ones in Big Tech facing this situation.”

South Africa And Atlanta Forge Partnership To Boost Trade, Investment, And Community Collaboration

The goal is to foster business between Atlanta and South Africa, leading to shared economic growth.

South Africa has signed a pledge with the city of Atlanta, Georgia, to bolster the connection between community leaders and increase United States investment in South Africa. The pledge signing occurred on Dec. 5 and was held during a trade and investment seminar hosted by the Department of Trade, Industry, and Competition at the Standard Bank headquarters.

The initiative marks a joint effort by the U.S. and the South African government to continue to promote a partnership and exchange between the two countries.

According to Engineering News, South Africa and the U.S. have a strategic partnership, as the States will help South Africa expand its investment overseas, supporting the “African agenda, economic integration, peace, security, and post-conflict reconstruction, and was a leading source of foreign direct investment (FDI).”

The signing event was hosted by the Atlanta Phambili initiative, which was launched in March. In attendance was Atlanta Mayor Andre Dickens, U.S. Ambassador to South Africa Reuben E. Brigety, Standard Bank CEO Sim Tshabalala, Gauteng Agriculture and Rural Development MEC Vuyiswa Ramakgopa, and Department of International Relations and Cooperation Deputy Director-General Maud Dlomo.

The pledge details growing shared democratic values and enduring friendly relations between South Africa and Atlanta while maintaining the long-standing history of civil rights, African diaspora connections, and the economic opportunity between Atlanta And South Africa.

The pledge states, “We commit to strengthening bilateral relations through the Atlanta Phambili initiative, leveraging the city of Atlanta and cities across South Africa as gateways to foster meaningful and lasting cooperation between our nations.”

It continues, “Through sustained engagements, we aim to foster shared prosperity, promote stronger trade and investment ties, increase knowledge exchange and technical collaboration, and deepen people-to-people cooperation.”

The Atlanta Phambil, a Georgia-based diplomacy initiative, played a pivotal role in the event. Committed to leveraging the economic and political resources of the U.S. Mission to South Africa, the organization focuses on fostering trade and strengthening economic ties between African businesses and those in the United States.

U.S. Ambassador Brigety explained, “We want to strengthen South Africa’s position as a premier destination for U.S. investors seeking to expand across the continent. Atlanta can bring experienced voices and institutional investors to the table for conversations about how we derisk investment in Africa and accelerate the continent’s global competitiveness.”

Dlomo added, “With this initiative, we envision and commit to working towards the intensification of trade and investment partnerships, people-to-people cooperation, and small business [development].”

Standard Bank CEO Tshabalala recognized the importance of this pledge at this particular time for South Africa, as the region has been growing rapidly as an economic and political juggernaut. “Start right here in South Africa. Why? Because South Africa is Africa’s largest, most industrialized, and most sophisticated economy, and because we have the strongest economic links both to the world economy and to the other economies on our continent,” he stated.

Jury Deadlocks On Manslaughter Charge For Daniel Penny, Now Considering Lesser Charge

Judge Maxwell Wiley only dismissed the manslaughter charge after the jury was deadlocked on that charge twice.

After jurors failed to reach a verdict on a manslaughter charge for Daniel Penny, a white former Marine accused of fatally choking Jordan Neely, a Black man with mental illness, on a New York City subway in 2023, they will reconvene on Dec. 9 to deliberate a lesser charge of criminally negligent homicide.

According to CNN, Judge Maxwell Wiley only dismissed the manslaughter charge after the jury was deadlocked on that charge twice, informing him that they could not agree on the charge.

The lesser charge of criminally negligent homicide only carries a maximum sentence of four years in prison, compared to 15 years in prison for manslaughter.

Judge Wiley could also opt not to give Penny any time in prison if convicted on the lesser charge.

https://twitter.com/ArtCandee/status/1865148155601338520?s=19

However, according to the judge’s instructions, he could only be convicted of either manslaughter or criminally negligent homicide, but not both charges at once.

According to The Gothamist, defense attorneys for Penny petitioned Judge Wiley for a mistrial, arguing that pressuring the jurors to come to a consensus after they sent two notes indicating they couldn’t was coercive and that the facts of the case were not that complicated.

Wiley told the defense lawyers, “I disagree that the facts aren’t complicated. It is a very factually complicated case.”

After jurors returned with more notes, including one asking for the definition of a “reasonable person” and another informing Judge Wiley that they couldn’t reach a consensus, prosecutors told the judge that they were considering dismissing the manslaughter charge.

After Judge Wiley indicated that he would dismiss the manslaughter charge in favor of the lesser charge, in accordance with a motion filed by the prosecution, he said that although there was no legal precedent for this, he said that the case is “unique” and he is willing to “take a chance and grant the prosecution’s application.” The defense has indicated that they will appeal the guilty verdict if their client is convicted.

Defense attorney Thomas Kenniff said in a statement released on Dec. 6 that although he was pleased with the dismissal of the manslaughter charge, he continued his argument that his client acted reasonably and hoped for an acquittal on the lesser charge.

“We are obviously very pleased with the Court’s decision to withdraw the top count of this indictment,” Keniff said. “However, we have always maintained that Danny acted reasonably in restraining Jordan Neely, and justice will not be served until he is acquitted of criminally negligent homicide as well. We are hopeful that will happen when the jury returns on Monday.”

According to The Gothamist, the bystander video depicts Penny placing Neely in a chokehold for several minutes. Penny’s interview with NYPD investigators featured prominently in the jury trial, and they asked to watch the videos multiple times.

In addition to this, defense attorneys attempted to argue that Neely’s sickle cell anemia played a role in his death, similar to arguments used in the trial concerning the death of George Floyd at the hands of the Minnesota Police Department.

Prosecutors countered this argument, in concert with numerous medical examiners, by saying that a pre-existing condition does not supersede external trauma, like a chokehold, being inflicted on a person.

They also noted that sickle cell disease predominantly affects Black people and is sometimes used in efforts to cover up the actual cause of death when Black people are killed in the custody of law enforcement.

In her closing arguments delivered on Dec. 2, prosecutor Dafna Yoran argued that although Penny had the intention of protecting his fellow passengers, “he just didn’t recognize that Jordan Neely’s life too needed to be preserved,” and argued that “we are here today because the defendant used way too much force for way too long in way too reckless of a manner.”

Vacant Historic Black Church In Virginia To Become Community Learning Center

First Baptist Church of Rocky Mount, Virginia, has supported its Black community and members through more than worship.

A vacant yet historic Black Church in Rocky Mount, Virginia, will transform into a gathering space and learning center for its community.

Built by Black Virginians in 1899, First Baptist Church of Rocky Mount has held multiple uses since its establishment. Despite stopping its sermons in 1965, it continued to support its Black residents as a hub voter registration and community action.

Currently, despite a stint as a beauty salon, it maintains its vacancy. However, the community will restore the church as a cultural heritage center.

“The story of the First Baptist Church of Rocky Mount, VA is deeply intertwined with our original church structure,” wrote the church on its restoration fundraising page. “Designed by architect Leonard Pinkard and built in 1899 by former slaves individuals and their descendants, this historic building has served as a beacon of faith, hope, and community for over 125 years.”

As for its modern iteration, the church’s leaders want the place to educate its community.

“The goal is to turn it into a place where people can gather and learn,” said Pastor Christopher Coates to WDBJ7.

As for what history it will detail, Coates shared their plans to install exhibits on the Black U.S. Soldiers from Franklin County.

“There will be a poster for each soldier to tell where he was from, what his rank was, his years of service, and any other pertinent details that the research team can put behind it,” Coates said.

However, their plans also extend to servicing attendees as it has for generations. It renovations include a complete reset of the second-floor and installation of modern upgrades that abide by ADA-compliances. They will host job training and tutoring to benefit those of all ages.

“We’re going to add some showers to help take the stress off the local warming center during the wintertime. We also want to make sure that this place is a place where people can receive job training, maybe academic tutoring, just a community hub. So, whatever there is a need, maybe the building can fill the need,” added Coates.

They hope to bring back the church’s original glory through its design, while still championing its mission to benefit Black people beyond the pulpit.

Roscoe’s Chicken And Waffles Gets Backlash For Inflatable Donald Trump Doll Near Restaurant

Roscoe’s Chicken And Waffles Gets Backlash For Inflatable Donald Trump Doll Near Restaurant

The backlash seems to stem from a feud with a content creator.

Digital creator Epicurious Expeditions has sparked a social media feud with Roscoe’s House of Chicken and Waffles COO Diana Vara, following the posting of a viral video showing fans how to recreate the restaurant’s iconic dish in their home. After a series of back-and-forth online, some fans are calling for a boycott of the famed chicken spot.

The controversy surrounding Roscoe’s Chicken and Waffles blew up for the public when Epicurious Expeditions posted a video on TikTok teaching viewers how to cook Roscoe’s signature chicken and waffles at home, as well as telling watchers to pass on going to the restaurant in favor of doing it themselves.

COO Vare was quick to respond in a now-deleted comment on Instagram. She wrote, “You can copy the recipe, but I guarantee the recipe won’t taste the same.”

But what began the wave to cancel Roscoe’s Chicken and Waffles was actually a giant Donald Trump blow-up doll. Epicurious Expeditions posted about it.

Roscoe’s House of Roscoe’s Chicken and Waffles has been a well-known staple for the Black community in Los Angeles. Now they’re facing backlash after videos surfaced of an inflatable Trump doll posted outside the soul food restaurant’s Long Beach location.

Back in November, Epicurious Expeditions posted a video on Instagram showing the blow-up doll for all to see, prompting an overwhelmingly negative response from the restaurant’s predominantly Black fanbase.

Despite Roscoe’s deep-rooted connection to L.A.’s Black community, with Black politicians and celebrities singing its praises and eating at their restaurant locations, the Southern California chain seemed to ruffle a lot of feathers with the blow-up doll and what some thought was an endorsement of Trump.

To add to the discourse, Epicurious Expeditions uploaded a 2022 Los Angeles County Department of Public Health on Dec. 3 that revealed multiple health code violations from the chain.

Epicurious Expeditions stated Roscoe’s “has been canceled by the internet.”

“Roscoe’s has been synonymous with Black LA culture,” the TikTok creator told Eater Los Angeles. “I grew up poor, and my mom would scrimp and save any time to take us to a restaurant that was a pillar of the Black community. For them to side with the man who supported the death penalty for the Central Park 5 and turn their back on us like this was painful.”

Vare has since defended the chain against the allegations and drama, though. In a since-deleted comment, Vare claimed that the Seabird Jazz Lounge, which is located next door to the chicken spot, had an event reserved in the space. She states that they were the ones who put the blow-up doll out front.

Vare explained, “The inflatable doll was brought from the LAGOP and URBT News, who hosted the watch party at the Jazz Lounge, which is located right next to Roscoe’s.”

She reiterated that the Trump inflatable was in no way associated with Roscoe’s, rather that it just looked that way due to the proximity of their locations.

Before Roscoe’s Chicken and Waffles feud with Epicurious Expeditions, the restaurant had some hard times. The chain has been open for nearly 50 years, and its original owner, Herb Hudson, is still contending with about $27 million in outstanding debt. Through the years, they’ve faced lawsuits and tragedy, notably when rapper PnB Rock was shot and killed at their Inglewood location two years ago. They’ve since closed two of their locations.

Reportedly, though, all the negative repercussions haven’t been getting to the restaurant chain, as Vare claims, “Ya’ll can stay canceling us, but business is up 20 percent.”

BLM Protestor Placed In Solitary Confinement Over 250 Days Despite Oregon’s 90-Day Limit

An incarcerated Black Lives Matter protester is staging hunger strikes to draw attention to his prolonged solitary confinement.

A Black Lives Matter protestor incarcerated in Oregon has spent over 250 days in solitary confinement despite the state’s 90-day limit.

Malik Muhammad, a disabled Army veteran living with PTSD, is currently serving a 10-year sentence after pleading guilty to 14 felonies in 2022 at the age of 25, The Intercept reports. However, his treatment in prison has sparked concerns, with at least eight incarcerated individuals filing grievances against corrections staff, alleging mistreatment of Muhammad, some of which is claimed to be racially motivated.

The Civil Liberties Defense Center, which advocates for the rights of political prisoners, took on Muhammad’s case last month. The organization is challenging the Oregon State Penitentiary and Department of Corrections for keeping Muhammad in solitary confinement for over 250 days despite his disability and the state’s 90-day limit on the controversial practice.

“We are talking about a conditions-of-confinement issue,” said Muhammad’s attorney, Lauren Regan, director of litigation and advocacy at the Civil Liberties Defense Center. “Malik is designated 100 percent disabled as a combat veteran because of extreme PTSD. And the Department of Corrections knows that.”

Muhammad accepted his fate after traveling from Indiana to join BLM protests in Kentucky and Oregon in 2020. During the demonstrations, he participated in firearms training in Kentucky and later threw a Molotov cocktail at police in Oregon.

His placement in solitary confinement followed an incident where, according to Regan, Muhammad requested to speak with a supervisor after being forced off the phone so a white inmate could take his place. But instead of a supervisor, Muhammad was Tased, beaten by guards, and subsequently placed in isolation.

“The next thing Malik knows is 10 corrections officers show up outside of his cell,” Regan said. “They stick two taser guns through the slot of the cell and start firing darts into the cell, and all of them strike him. He’s got nowhere to go. And they then just start repeatedly cycling the electric shocks of the taser over and over.”

“Even after he is on the ground and completely incapacitated because he’s being electrocuted, they continue,” Regan said. “They kick and punch him.”

In May, Muhammad began his first hunger strike. He initiated his latest strike in November after spending more than eight months in solitary confinement. According to Regan, prison regulations mandate that corrections staff involve the medical team for a baseline evaluation within 48 hours of learning about a hunger strike. However, six days into the strike, no medical assessment had been conducted for Muhammad.

Solitary confinement has been shown to worsen mental health conditions, with prolonged use widely regarded as a form of torture by human rights and civil liberties organizations. The Oregon Department of Corrections sets a 90-day limit on consecutive solitary confinement, which is significantly longer than states like California, with a 10-day maximum, or New York, which caps its use at 15 days. At least 17 other states have recently considered imposing limits of 10 to 15 days.

However, according to Regan, the Department of Corrections restarts the clock whenever an individual is moved between different housing categories. This practice has allowed Muhammad to remain in solitary confinement far beyond the 90-day limit.

“The way that the DOC is attempting to sort of sneak this under the radar is that they have multiple different segregation designations,” Regan said.

Muhammad’s designation has changed from one segregated housing unit to another, “but he’s literally staying in the same solitary confinement cell,” Regan said.

Regan stated that as a veteran with PTSD, the treatment Muhammad has endured in prison will make his reintegration into society even more challenging.

“He served the country and he already really suffered through one episode of his life that has given him some of the mental health issues that may have contributed to the acts that he’s actually been convicted of,” she said.

“For the racist prison system to intentionally punish him in ways that are going to cause additional mental health impacts and just make it that much harder for him to come out and be a productive and lovely member of our community is the opposite of what the prison systems say they are doing.”
